Be­fore con­duct­ing each trans­ac­tion, a free con­sul­ta­tion with the No­tary is re­quired as to in­di­vid­u­al­ly agree on the form of the ac­tiv­i­ty and to ob­tain a list of nec­es­sary doc­u­ments as well as es­tab­lish the costs con­nect­ed with the trans­ac­tion.

No­tar­i­al ac­tiv­i­ties may be per­formed out­side the Of­fice if the na­ture of the ac­tiv­i­ty or par­ti­cu­lar cir­cum­stances so re­quire.

Be­low there is a list of ba­sic doc­u­ments nec­es­sary to per­form no­tar­i­al ser­vices:
  • for the con­tract of sale of an apart­ment or busi­ness premis­es:
    • valid ex­tract from the land and mort­gage reg­is­ter
    • a doc­u­ment be­ing the ba­sis of ac­qui­si­tion (e.g. copy of a no­tar­i­al deed, court de­ci­sion on in­her­i­tance ac­qui­si­tion)
    • a cer­tifi­cate is­sued by a com­pe­tent Head of the Rev­enue Of­fice on pay­ing an in­her­i­tance and en­dow­ment tax – if the ac­qui­si­tion of a prop­er­ty took place on the ba­sis of in­her­i­tance or a con­tract of do­na­tion con­clud­ed af­ter Jan­uary 2007
    • ID cards of per­sons par­tic­i­pat­ing in trans­ac­tion and their NIP (Tax iden­ti­fi­ca­tion) num­bers
  • for the prepa­ra­tion of a con­tract of sale of the co­op­er­a­tive mem­ber’s own­er­ship of apart­ment or busi­ness premis­es:
    • valid ex­tract from the land and mort­gage reg­is­ter if it is kept for the own­er­ship be­ing sold
    • a doc­u­ment be­ing the ba­sis of ac­qui­si­tion (e.g. al­lo­ca­tion, copy of a no­tar­i­al deed, con­tract for trans­form­ing the co­op­er­a­tive hous­ing ten­an­cy right into the co­op­er­a­tive mem­bers’’ right of own­er­ship, court de­ci­sion on in­her­i­tance ac­qui­si­tion)
    • ID cards of per­sons par­tic­i­pat­ing in trans­ac­tion and their NIP (Tax iden­ti­fi­ca­tion) num­bers
  • for the prepa­ra­tion of a con­tract of sale of a real prop­er­ty be­ing a de­vel­oped or va­cant plot of land:
    • valid ex­tract from the land and mort­gage reg­is­ter
    • a doc­u­ment be­ing the ba­sis of ac­qui­si­tion (e.g. copy of a no­tar­i­al deed, court de­ci­sion on in­her­i­tance ac­qui­si­tion)
    • an ex­tract from the land reg­is­ter with a com­ment that the doc­u­ment is to be used for mak­ing an en­try in the land and mort­gage reg­is­ter (is­sued by a com­pe­tent Starost­wo Powia­towe)
    • a cer­tifi­cate of the in­dent­ed use of the plot in the spa­tial land de­vel­op­ment plan or of lack of such a plan with­in a giv­en area (with­in a com­pe­tent Mu­nic­i­pal Of­fice)
    • ID cards of per­sons par­tic­i­pat­ing in the trans­ac­tion and their NIP num­bers
